GENERAL TERMS & CONDITIONS (English)
INTRODUCTION
Johnstone, Eduarda & Jesus Lda. (JES), which also operates under the brand Quinta Rentals by JESⓇ, is a Portuguese company operating in Portugal, specialising in the rental of properties for holiday purposes and in the provision of related services under the Alojamento Local regime.
These Terms and Conditions, which may be amended from time to time, apply to the services provided by JES to any third party booking holiday rentals in the properties made available by JES for such purposes (Guests). Any amendments to these Terms and Conditions will be updated on our website.
These Terms and Conditions are governed by Portuguese Law and any disputes arising from them shall be submitted to the Portuguese courts.
These Terms and Conditions apply to the business-to-consumer (B2C) relationship between JES and the Guests. The relationship between JES and the owners of the properties (Owners) used by JES for the holiday rentals is governed by private agreements entered into for that purpose between the parties concerned.
In addition to the general rules and policies set out herein, there may be specific rules for the use of each property, which will be duly disclosed in the relevant information available on JES website.
By accessing a website owned by JES and making a reservation, the user acknowledges that they have read, understood and agreed to the Terms and Conditions set out below.
The information contained in the website is property of JES. Any downloading, reproduction or forwarding of such information, in whole or in part, for commercial purposes is strictly prohibited.
DESCRIPTION
JES makes every effort to ensure that the accommodation is described accurately. All representations and descriptions made by JES or its employees, whether in advertising materials, correspondence or or verbal communications, are provided in good faith, and do not create any binding liability.
The photographs of the rental properties are, to the best of JES´s knowledge, accurate and based on the information provided to JES by the Owners. Every effort is made to keep this information up to date. However, occasionally changes (for example, in furnishings or décor) may occur for reasons beyond the control of JES, for which JES cannot accept responsibility.
PAYMENTS
A deposit of 35% of the total quoted cost must be paid within three (3) working days of booking, in order to secure a provisional booking. Until the deposit is received, the booking remains an enquiry only and the property may be reserved by another Guest. If the deposit has not been paid by the due date, JES reserves the right to cancel the booking.
Payments can be made by bank transfer or credit card; cheques are not accepted.
An additional rental charge applies per person for the use of an extra folding bed, sofa bed (single or double) or cots. Please request details before making your booking so that JES can confirm the property meets your requirements.
The Deposit will be deducted from the total quoted cost. The balance payment must be made no later than six (6) weeks prior to the start of the rental period. Once the balance is received, the booking is confirmed. If full payment is no received by the due date, JES reserves the right to cancel the booking and retain any monies previously paid.
For bookings made less than six (6) weeks before the rental start date, full payment is required at the time of booking. JES will confirm the booking once full payment has been received.
Prices are subject to change due to exchange special offers. However, once a booking has been confirmed, the price is fixed and will not change. All prices are in EURO and include VAT.
In-line with Portuguese Legislation, all rental properties are AL registered. A copy of each Guest´s passport or identity card will be required and kept at Reception. Accommodation is limited to a maximum of two (2) people per bedroom, unless otherwise agreed in advance and authorised by JES.
The Lead Booker must be at least 21 years old. The property is reserved exclusively for the people named on the booking confirmation (for which JES requires prior name and passport/ID details, in accordance with our Privacy Policy). The number of Guests may not exceed this. Any unauthorised person(s) found staying at the property will be required to leave immediately.
It is the Guest’s responsibility to ensure they have valid passports, visas or driving licences where required. JES cannot be held responsible for failure to carry the correct travel documentation.
SECURITY DEPOSIT
A Security Deposit is required to cover any damages or loss of items, with the amount ranging between €250,00 - €3.000,00 depending on the property and specified at the time of booking.
The Security Deposit can be provided either as an upfront payment when paying the balance or by credit card pre-authorization allowing JES to charge the amount if necessary.
The Security Deposit is intended to ensure that the property is returned in good condition.
If the Security Deposit is paid upfront it will be refunded within one month after departure provided no damages has occurred, but if damage or loss is found the Security Deposit or part of it may be retained until the issue is resolved or the item replaced.
If damages exceed the Security Deposit amount, the Guest is responsible for paying the outstanding balance to JES in Euros.
PROMOTIONAL CAMPAIGNS
From time to time JES may offer promotional discounts on bookings for specific properties and within a defined period of time.
These promotional discounts are only be valid while available online and under the conditions disclosed, and JES is not obliged to extend any discounts once the promotional campaign has expired.
Existing bookings cannot be transferred to a property with a promotion at a later date, may it be the same property or a different one.
If a Guest chooses to cancel or transfer a booking made under a promotional campaign, the deposit will be lost.
UTILITY USAGE
Electricity usage is included in the rental price per week with Apartments allocated 200 units per bedroom and Villas allocated 500 units per bedroom.
If Guests exceed their allocated units, they will be charged €0,35 (thirty-five cents) per additional unit or alternatively the amount will be deducted from the Security Deposit.
HOUSEKEEPING
For stays of 7 nights, the rates include a midweek bathroom towel change. For stays of more than 7 nights, the rates include a weekly changeover clean, bathroom towel change and bedroom linen change.
Extra maid service can be requested at the time of booking; this request must be made in writing in advance and will be charged accordingly. Maid Service (where applicable) includes bedrooms, bathrooms, living room and floors. The washing of personal laundry, kitchen pots, pans, dishes and the cleaning of the BBQ are not included in the maid service.
Regrettably, if the maids are turned away by the Guests at the time of the scheduled clean, they will not be able to return later and no refund will be issued.
Upon departure, if the property is not left in a reasonably clean and tidy condition and additional cleaning is required above the normal departure cleaning hours, the cost will be deducted from your security deposit.
CLEANING PRODUCTS
All rental properties are self-catering and thus a complimentary “starter pack” is provided. Depending on the size of the property, this usually includes a small bar of soap, a small or medium bottle of bath gel, shampoo and conditioner, as well as one toilet roll in each bathroom.
Any further supplies (including toilet rolls) must be purchased by the Guest as required.
GARBAGE/RUBBISH
It is the Guests’ responsibility to dispose of their garbage/rubbish in the designated local bins both during their stay and upon departure.
If, on departure, the property is not left in a reasonably clean and tidy condition or if garbage/rubbish has not been properly removed and disposed of, and additional cleaning is required, the corresponding an amount will be deducted from the security deposit.
BEHAVIOUR
Guests are expected to behave responsibly and with consideration for others at all times. If Guests behave in a way that causes or is likely to cause danger, disrespect, distress, annoyance, over occupying or damage to others (including Owners, other Guests, JES staff or the property), JES reserves the right to terminate the holiday arrangements immediately. In such cases, JES will have no further liability and will not be responsible for any resulting expenses, refunds, or compensation.
Noise is not permitted between 11 p.m. and 7 a.m. or at any other time if it causes nuisance or annoyance to neighbouring properties. A Security company patrols the site throughout the night and has been instructed to intervene with any persons in breach of this rule. Notices will be served to persistent offenders and further action may be taken as necessary.
We kindly ask Guests to show consideration for others who are also on holiday. For Rentals in a Condominium area, Guests are required to respect the Condominium Rules to ensure a pleasant stay and the possibility of being welcomed back in the future.
If a property has a fire place, guests must take care when using fireplaces inside the property and be remain vigilant with children around fires and fireplaces. JES will not be liable for injury caused by negligence around fires and fireplaces. Please note that in the São Lourenço Condominium fire BBQ’s are strictly prohibited.
The use of fireworks, illegal substances or similar prohibited items is strictly forbidden in any property and its premises under any circumstances.
During the stay, Guests are responsible for ensuring that the property is securely locked when leaving and that they retain their keys for re-entry. Depending on the size of the accommodation, one (1) or two (2) keys will be issued for Guests’ use. Lost keys will require replacement of the lock for security reasons, including fitting and administration time, at a minimum charge of €100.00 plus 23% IVA.
Vehicles must be parked only in designated parking areas. Parking on the grass or calçada (Portuguese cobble stones pavement) walkways is not permitted.
SWIMMING POOL
The swimming pool is not supervised and Guests use it entirely at their own risk. Diving is strictly prohibited in any Condominium Pool. Children must always be accompanied and supervised by a responsible adult.
Only plastic drinking glasses are permitted in the pool area; glassware is strictly forbidden. All items must be removed from the poolside when leaving the area.
Guests are kindly requested not to enter the pool with excessive amounts of sun cream or tanning oil on their skin, as this may damage the filtration system.
JES will take immediate action upon notification of any malfunction of the swimming pool. However, JES cannot be held liable for any such malfunction.
SMOKING
Smoking is strictly prohibited in all properties. Should smoking be detected inside the property, JES reserves the right to withhold the security deposit, in full or in part, to cover any necessary cleaning or damages.
PETS AND ANIMALS
Pets and animals are not permitted in some properties. Before making a booking, Guests must confirm whether the chosen property is pet friendly. Any request to bring pets must be made in writing at the time of booking; otherwise, pets and animals are not allowed on the premises of any rental property.
CANCELLATION
In the event of a cancellation, written notification must be sent by the person who made the booking to the following email address rentals@jesql.com
The deposit (35% of the booking value) is strictly non-refundable. The remaining balance (65%) may be refundable depending on the number of days prior to Check-In that the cancellation is received:
Refund Policy:
More than 60 days before Check-in - 100% of the balance is refundable
Less than 60 days before Check-in - 0% of the balance is refundable
Please note that these percentages apply only to the balance amount and do not include the deposit.
Failure to occupy the booked accommodation, refusal to accept the property on arrival or any change of dates by the Guest will be treated as a cancellation. In such cases, JES reserves the right to resell all or part of the booking, without prejudice to its right to collect the applicable cancellation charges in full.
INSURANCE
Holiday travel insurance is not included in Guests’ bookings. Guests are therefore strongly advised to obtain adequate insurance at the time of booking. Such insurance should cover, but not be limited to: cancellation, personal accident and liability, medical expenses, loss of luggage, cash, documents, legal expenses, and theft.
If Guests choose to bring valuables, these should be individually insured against all eventualities and either kept securely locked away or carried on the Guests’ person at all times. Cash and jewelry must likewise be secured or kept with Guests at all times.
JES accepts no responsibility for any material loss, as most of the properties are equipped with a safe for Guests’ use.
SECURITY
If a property is equipped with security locks on the doors, lockable shutters, secondary locks on sliding doors and windows, and a safe for valuables and documents, Guests are strongly advised to use them for their own protection. Where security alarms are installed Guests should ensure they are set at all times.
Demonstrations on how to operate the alarms are available from the JES team upon request.
LIABILITY
JES shall not be held liable under any circumstances for cancellations, withdrawals, alterations to arrangements, or for any damage, or accidental expenses resulting from war, civil strife, strikes, sickness, quarantine, adverse weather conditions, natural disasters, technical problems of any kind, terrorist activities, airport closures, or any other circumstances beyond their reasonable control.
JES will not be liable:
i. for any loss or damage to luggage, goods, or personal belongings of the Guest, except where such loss or damage is caused by the fault or negligence of JES’ employees during the Guest’s stay;
ii. for any actions of third parties or for the failure of any public service or technical supply connected with the holiday arrangements over which JES has no direct control.
Subject to the limitations set out in these Terms and Conditions and to the extent permitted by law, JES shall only be liable for direct damages suffered, paid, or incurred by a Guest as a result of an attributable shortcoming in the provision of our services.
In the unlikely event that, due to extraordinary circumstances, the accommodation becomes unavailable after confirmation and full payment has been received, JES will immediately inform the Guest and make every effort to relocate and/or upgrade the accommodation. Our aim is to provide suitable alternative accommodation similar to the originally chosen property, within a 20Km radius. If an alternative cannot be provided, or the Guests is dissatisfied with the alternative, a full refund of accommodation payments received will be made.
In the unlikely event of failure of electrically supplied apparatus, JES cannot be held responsible, but will endeavor to assist Guests when possible and ensure that replacement apparatus is supplied.
Any fault with an air conditioning unit will be treated as a priority and all reasonable efforts will be made to repair or provide a portable unit if available. Keeping all internal doors open will allow remaining units to maintain sufficient cooling within the property.
LOST & FOUND
Any personal items left behind in the property after departure will be treated as lost property. JES will retain found items for a maximum period of 90 days from the departure date.
During this period, Guests may:
If no contact or instruction is received within the stated timeframe, JES reserves the right to permanently dispose of the items.
EMERGENCIES & CONTACT NUMBER
In the event of an emergency (such as fire, flooding, or a major power or water outage) where Guests are unable to remain at their booked property, JES may allocate compensation up to a fixed amount per person, based on the rate paid per person for the Guest´s rental accommodation with JES.

BUILDING WORKS
JES will take reasonable steps to monitor and inform Guests if any building work within a 50 meter radius is likely to affect the booked property during their stay. Should JES, at its sole discretion, consider that work on a neighboring plot would significantly impact the property due to noise and/or dust we will make reasonable efforts to offer Guests an alternative property. If no suitable alternative is available, JES may, at its sole discretion, provide a discount on the booking price.
Where roadworks or public works occur at short notice or without notice, and are beyond the control of the Owner or JES, cannot be held liable for any inconvenience caused to Guests.
COMPLAINTS
In the unlikely event that Guests have a complaint during their stay, they should immediately notify JES Reception or email rentals@jesql.com who will make every effort to resolve the issue without delay. Any claim against JES must be submitted in writing on the day the complaint occurs and no later than 24 hours after the Guest’s departure.
ARRIVAL & DEPARTURE
There are no fixed changeover days, as flights are available on most days. Properties will be ready for arrival after 16:00 and the standard departure time is 10H00. Guests are kindly requested to inform JES of their approximate arrival time to help ensure the property is ready for occupancy.
If your arrival time is expected outside normal operating hours, Guests must inform Reception so that the keys can be placed in a specially designed secure key box at the property.
JES reserves the right to charge for additional occupancy on a daily basis, which may be deducted from the Security Deposit, if the property is not vacated by 10.00am on the day of departure without prior written consent.
For Guests arriving at the airport, JES can assist with transport requirements, including arranging a taxi, car hire or VIP service.
